Brenda Moody Whinery

After nearly five years as United States Trustee for Arizona (Region 14), as well as Acting United States Trustee for Southern California, Hawaii, Guam, and the Northern Mariana Islands (Region 15), Brenda Moody Whinery joined Mesch, Clark & Rothschild, P.C. in September of 2002. In addition to her term as a U.S. Trustee, Ms. Whinery had more than twelve years in private practice in Phoenix in the areas of bankruptcy and creditor's rights. 

As Trustee, Ms. Whinery oversaw the administration of bankruptcy cases in federal courts in her various jurisdictions. Her responsibilities also included running the offices she was in charge of, including managing the employees in each district, establishing regional goals and policies, enforcing national policy, and selecting and overseeing private trustees in Chapter 7, 11 and 13 cases. She handled strategic guidance and legal decision-making and participated on national committees and in public speaking engagements at seminars and conferences.

At Mesch, Clark & Rothschild, P.C., Ms. Whinery is a Shareholder and a member of the Bankruptcy Section.  She specializes in commercial bankruptcy representation as counsel to official committees of unsecured creditors, secured creditors, trustees and debtors. Recent Committee representations include, the Crown Pacific Limited Partnership Chapter 11 cases (six jointly administered cases) and the Official Committee of Unsecured Creditors in the Rawhide, Inc. Chapter 11 cases (four jointly administered cases). She is currently serving as Chapter 11 Trustee in the Fort Defiance Housing Corp., Inc. case. Other practice areas include creditors’ rights and real estate transactions.

She received her J.D. in 1985 from the University of Arizona College of Law in Tucson, where she was Note Editor for the Arizona Law Review from 1984 to 1985.  In 1982, Ms. Whinery earned a Bachelor of Science degree in Business Administration with high distinction, also from the University of Arizona.

Ms. Whinery is a fifth generation Arizonan and has occupied a number of professional leadership positions. In October 1997, she was selected by the Ninth Circuit Judicial Conference to serve a three-year term as an Arizona Lawyer Delegate to the Ninth Circuit.  During 1996-1997, she headed the Bankruptcy Section of the Arizona State Bar.  Ms. Whinery was also named by Today's Arizona Woman as one of Arizona's 100 top women in business in 1997 and 1998.  Ms. Whinery also served as a Trustee of the Carondelet Foundation, and is currently a member of CREW (Commercial Real Estate Women), a member of the Arizona Women Lawyers Association and a member of the Federal, American, Arizona and Pima County Bar Associations.
